Terms of Use

Welcome to the Wine Vision by Open Balkan website (the “Site”). These Terms of Use (“Terms”) govern your access to and use of the Site, event registration platform, and related services (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Services.

1. Eligibility and Acceptance

User Eligibility

The Services are intended for exhibitors, professional buyers, and visitors of the Wine Vision by Open Balkan fair. Users under 18 years of age are allowed to register or make purchases only with the consent and supervision of a parent or legal guardian.

If you are under the age of consent in your country (for example, under 16 in the EU or under 15 in Serbia), your parent or guardian must review and agree to these Terms on your behalf. By using the Services, you represent that you meet these eligibility requirements or have obtained the necessary consent.

Acceptance of Terms

You agree to comply with these Terms and all applicable laws and regulations when using the Services. These Terms form a binding agreement between you and the organizers of Wine Vision by Open Balkan (referred to as “we,” “us,” or “our”). The organizers may update these Terms from time to time and will post updated Terms with a new effective date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.

2. Accounts and Registration

Account Creation

Some features (such as registering as an Exhibitor or Pro Buyer) may require you to fill out registration forms or create an account. You agree to provide accurate, current, and complete information during registration and in any subsequent use of your account or forms. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

Account Security

You must promptly notify the organizers at [email protected] of any unauthorized use of your account or any other breach of security. The organizers will not be liable for losses caused by any unauthorized use of your account.

Profile Data

During registration, the organizers collect extensive personal and business information (e.g., full name, contact details, company information, professional experience, VAT/IBAN, social media links, file uploads). You must ensure all information provided is truthful and lawful. Misrepresentation of your identity or credentials is a violation of these Terms.

3. Purchases and Payments

Wine Vision by Open Balkan offers products and services for sale through the Site, including exhibition stand space, booth equipment rentals, and advertising opportunities for the event (“Order” or “Purchase”). The following terms apply to all Orders:

Pricing and Taxes

All prices for stands, equipment, or advertising materials will be clearly indicated before purchase. Prices are listed in local currency (Serbian Dinar – RSD) or Euros, as specified, and include applicable taxes or indicate if taxes (such as VAT) will be added. The organizers reserve the right to correct obvious errors in pricing and to modify prices prior to confirmation of your Order.

Payment Processing

Payments are processed securely through Raiffeisen Bank. The organizers accept major credit/debit cards and other payment methods as provided by Raiffeisen's payment gateway. All financial information (like card details) is handled by the bank's secure system; we do not store your card numbers or CVV codes on our servers. Online payment pages are encrypted for security. By making a Purchase, you authorize the organizers or their payment processor to charge the total amount to the payment method you provide.

Order Confirmation

Your Purchase is considered confirmed once payment is successfully completed and you receive a confirmation email or invoice. The organizers reserve the right to reject or cancel any Order for reasons including inability to process payment, suspected fraud, or unavailability of the service/product ordered. In such cases, the organizers will notify you and provide a refund if payment was already made.

Contract Formation

When you purchase stand space, equipment, or advertising, you enter into a contract with the organizers to deliver the specified event services. Additional terms specific to exhibitors (such as Exhibition Rules or technical guidelines) may apply and will be provided separately or during the application process. Exhibitors must abide by all event rules (e.g., venue regulations, safety rules) in addition to these website Terms.

4. Cancellations and Refunds

Cancellations and refunds are handled in accordance with the Return Policy. If you need to cancel your participation as an exhibitor or cancel an Order for equipment/advertising, you must follow the procedures and timelines in the Return Policy. Depending on when the cancellation is made, you may receive a full or partial refund, or no refund for late cancellations.

If the organizers cancel or significantly alter the event, you will be entitled to a refund of fees paid, as described in the Return Policy. Please refer to the Return Policy for complete information on cancellation deadlines, refund processing, and any applicable fees.

5. Permitted Use and Conduct

By using the Services, you agree to:

• Lawful Purposes: Use the Services only for legitimate purposes and in accordance with these Terms and applicable laws.
• Provide Accurate Information: Ensure that any information you provide (during registration, purchase, or any communication) is true, accurate, and up-to-date.
• Respect Other Users: Treat other participants (exhibitors, buyers, visitors) with respect in any interactive portions of the Site or event.

Prohibited Activities

You are expressly prohibited from using the Services to:

• Violate Laws or Rights: Engage in any activity that violates any law or infringes the rights of any party. Do not use the Site to transmit any content that is unlawful, defamatory, obscene, or that violates intellectual property or privacy rights.
• Security Breaches: Attempt to gain unauthorized access to any portion of the Site or Services, other user accounts, or any systems or networks connected to the Site.
• Malicious Code: Upload or transmit any viruses, malware, ransomware, or other harmful code via the Site.
• Fraudulent Activities: Impersonate any person or entity, or falsely state or misrepresent yourself.
• Interfere with Service: Interfere with or disrupt the operation of the Services or the servers/network that host the Services.

The organizers reserve the right to investigate and take appropriate legal action against anyone who violates these rules, including terminating accounts or blocking access to the Site.

6. Intellectual Property

All content and materials available on the Site and Services — including text, images, graphics, logos, videos, design, and software — are the property of Wine Vision by Open Balkan or its content suppliers and are protected by copyright, trademark, and other intellectual property laws.

Limited License

The organizers grant you a limited, revocable, non-transferable license to access and use the Site for its intended purposes, for personal or internal business use only.

Restrictions

You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any content or information obtained from our Site without our prior written consent. Downloading or printing content for your reference is allowed, but removing or altering any copyright, trademark, or other proprietary notices is prohibited.

7. User-Submitted Content

The Services may allow you to submit content (for example, filling forms, uploading documents or images for your exhibitor profile). By submitting any content through the Site:

• License to Use: You grant the organizers a worldwide, non-exclusive, royalty-free right to use, reproduce, adapt, publish, translate, distribute, and display your submitted content, solely for operating, promoting, and improving the Services and the event.
• Your Responsibility: You are solely responsible for any content you submit. You agree not to submit anything unlawful, defamatory, obscene, hateful, or infringing upon the rights of any third party.
• No Confidential Material: Do not submit confidential or proprietary information through open forms on the Site.

8. Third-Party Links and Services

The Site may contain links to third-party websites or integrate third-party services (for example, the Raiffeisen Bank payment gateway). These third-party sites and services are not under the organizers' control, and they are not responsible for the content, policies, or practices of any linked third-party website.

If you follow a link to an external website, be aware that those sites have their own terms and privacy policies. The organizers do not endorse or assume any responsibility for third-party content or services.

9. Disclaimers and Warranties

The Services (including the Site and all its content) are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the organizers disclaim all warranties of any kind, whether express or implied.

• We do not warrant that content on our Site is absolutely accurate, complete, or up-to-date.
• We do not guarantee that the Services will be available uninterrupted or error-free.
• We disclaim any warranties of merchantability or fitness for a particular purpose.
• We make no warranty that the Site or its content will be free from claims of infringement.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Wine Vision by Open Balkan, Belgrade Fair, their affiliated organizers, or any of their respective directors, officers, employees, agents, or partners be liable for:

• Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
• Event-Related Losses: The organizers are not responsible for travel or accommodation expenses if the event is changed or canceled.
• Total Liability Cap:The organizers' total aggregate liability is limited to the amount you paid to them for the specific service or purchase in question.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wine Vision by Open Balkan, its organizing entities (including Belgrade Fair), partners, and their respective officers and employees, from and against any and all losses, liabilities, claims, demands, damages, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Services; (b) your breach of these Terms or violation of any law or rights of a third party; or (c) any content you submit or actions you take through the Site that cause harm.

12. Event Changes and Force Majeure

Wine Vision by Open Balkan strives to deliver the event as advertised, but we reserve the right to modify the event program or details (such as schedules, venues, participants) at our discretion. Such changes will be communicated via the Site or email notifications.

The organizers shall not be held in breach of these Terms or liable for any failure or delay in performance if such failure/delay results from circumstances beyond their reasonable control, including acts of God, war, terrorist acts, labor strikes, epidemic, government restrictions, or power/internet outages.

13. Governing Law and Jurisdiction

These Terms and any disputes arising under or related to these Terms or the use of the Services shall be governed by the laws of the Republic of Serbia, without regard to its conflict of law principles. By using the Services, you agree that any disputes or claims shall be exclusively subject to the jurisdiction of the competent courts in Belgrade, Serbia.

Serbia is not a member state of the European Union. Consumers resident in Serbia are protected by the Serbian Consumer Protection Act (Zakon o zaštiti potrošača). Consumers resident in an EU member state may additionally invoke the consumer-protection and data-protection laws of their country of residence. The organizers will, in good faith, attempt to resolve any dispute through negotiation or mediation.

14. Changes to These Terms

The organizers may modify or update these Terms of Use from time to time. If they make material changes, they will notify users by posting the updated Terms on this page and updating the “Effective Date” at the top. By continuing to use the Services after updated Terms are posted, you agree to the revisions.
